savori is an app and service provided by Tim Oberhauser in Switzerland. By using savori, the user (hereinafter "User") acknowledges having read, understood and agrees to be bound by these Terms of Use.

Basic conditions

savori is provided to the User free of charge. However, some features of savori may only be available through a subscription or paid purchase. In order to use all of savori's features, registration as a user with a user account, including a username and valid email address, and access to the Internet may be required.

savori may be made available in part through app stores and related infrastructure, such as the Apple App Store and the Google Play Store. The use of such app stores is done by the user independently of Tim Oberhauser and the respective terms of use apply.

For some functions, savori needs to access photos, location information and other data on the User's smartphone, which savori may only access with the User's express consent. For example, such access allows the user to add a profile picture to their user profile or receive ingredient or recipe suggestions based on their geographic location. Depending on the operating system used, the User may have to explicitly confirm such access or may explicitly block access for savori.

savori allows messages to be sent between savori users and to third parties, including email messages. The User expressly agrees to receive such messages and agrees not to send messages through savori that violate any laws, and not to cause others to send such messages. savori shall have the right to contact the User at any time with messages through savori or by email.

savori may suggest recipes from external sources (hereinafter referred to as "Recipe Sites") via the savori app. In this context, savori acts exclusively as an intermediary and service provider. Users acknowledge and agree that the content of the Recipe Sites may be subject to its own Terms and Conditions and a separate Privacy Policy, both of which are the sole responsibility of the operators of the Recipe Sites. The user acknowledges that the recipes along with the corresponding images shown within the savori app are intellectual property of the operators of the Recipe Sites and are subject to copyright and other applicable intellectual property rights.

savori enables users to order goods from selected cooperation partners of savori (hereinafter referred to as "Merchants") directly via the savori app. The contract between the Merchant and the respective savori user is concluded directly between the Merchant (as seller) and the user (as buyer). In this context, savori acts exclusively as an intermediary and service provider for the Merchant and the User, but does not itself become a party to the contract. Users acknowledge and agree that their contract with the Merchant may be subject to the Merchant's Terms and Conditions and a separate Merchant Privacy Policy, both of which are the sole responsibility of the Merchant.

With respect to User Content that is subject to intellectual property rights, User expressly grants Tim Oberhauser a royalty-free, sublicensable, non-exclusive, worldwide license to use such content in connection with savori, subject to any mandatory legal requirements.

Tim Oberhauser will use its best efforts to ensure high availability and reliability of savori ("best efforts"). However, Tim Oberhauser expressly cannot guarantee that savori or individual functions of savori will be available all the time, at all times and/or in full. Tim Oberhauser recommends the User to perform a regular data backup of his smartphone including savori.

The user has no legal claim to the use of savori. Tim Oberhauser may discontinue the provision of savori at any time without giving reasons or exclude the User from using savori. Tim Oberhauser may change savori at any time without giving reasons, especially with regard to any paid functionalities.

Limitation of liability

Subject to mandatory legal provisions, Tim Oberhauser accepts no liability for direct or indirect damages arising from the use of savori or in connection with savori.

Tim Oberhauser assumes no responsibility for the contents of aforementioned Recipe Sites. Recipes may be displayed within the savori app in shortened form. There is no guarantee for the correctness of this data.

In case of violations of these terms of use as well as in case of infringement of rights and corresponding claims of third parties, the user expressly releases Tim Oberhauser from any liability and is fully liable for damages to Tim Oberhauser.

General terms

Tim Oberhauser may change these Terms of Use at any time. The user will be informed of such changes in an appropriate manner. The user may stop using savori at any time. By continuing to use savori after notification of changes to these Terms of Use, the user expressly agrees to such changes.

Subject to mandatory legal provisions, the use of savori is governed exclusively by Swiss law with Basel (Switzerland) as the exclusive place of jurisdiction.
